Short Term Missions Release Waiver

REVIVAL MINISTRIES INTERNATIONAL EVANGELISTIC ASSOCIATION INC. ( hereafter referred to as RMIEA Inc.) is a non-profit agency whose primary field of operation is West Africa, Haiti, and the Philippines. However, Revival Ministries Intemational Evangelistic Association Inc. also facilitates trips to other countries on the North and South American continent and Europe. Any individual who accompanies RMIEA Inc. as missionaries to one of these countries on a missionary trip, do so freely and of their own accord. We are glad to act as a host organization while on a ministry trip to one of these countries by suggesting activities and providing transportation after arriving in said country. We do, however, require that each individual accompanying RMIEA Inc. on a ministry trip sign the following agreement:
The undersigned passenger has applied for a tour to be conducted by RMIEA Inc. The undersigned passenger expressly understands and agrees to, and that the following terms and conditions shall be a part of this transaction with RMIEA Inc. with respect to the tour:
RMIEA Inc., its representatives and employees are to act as trip coordinators and tour leaders of tours set if by the tour group. It is an express condition of passenger's participation that the trip coordinators and tour leaders shall not become liable for delays, losses or accidents incurred by said persons or operators to passengers and baggage from whatever cause. Trip coordinators and our tour leaders shall not be held responsible for any disruption of travel and / or related services in any areas due to monetary crisis, political or social unrest, labor problems, mechanical or construction difficulties, climatic aberrations, local laws, disease or any other conditions.
RMIEA Inc. also reserves the right to cancel a tour, change routing, hotel and/or sightseeing and any other services offered should local conditions warrant. The extra costs, if any, must be paid by the passenger.
The right is reserved to refuse any person further participation or services on a tour, either before or during a trip. Further, neither RMIEA Inc. nor any of its representatives or employees are to be held responsible for any act or omission or event during the time the passenger is not on board the plane or conveyances.
REVIVAL MINISTRIES INTERNATIONAL EVANGELISTIC ASSOCIATION INC., its employees and/ or representatives assumes no liability for any losses, travel related or otherwise, not directly caused or inflicted by any of them.
In further consideration of the services extended by RMIEA Inc., the passenger fully and finally releases and discharges RMIEA Inc., its representatives, agents, employees, servants or any of them, all actions, claims and demands whatsoever which the passenger may have or which may hereafter accrue in favor of the passenger, or passenger's heirs, devisees, legatees, dependents, or any other person or organization claiming by, through or under said passenger (including but not limited to all injuries to the person or property of the passenger) arising out of any matters, incidents, acts, equipment and / or circumstances, which any of them might otherwise now or hereafter have or sustain, upon any theory of liability whatsoever or howsoever claimed unless such liabilities arises as the result of the intentional or wilful misconduct of RMIEA Inc., or their employees or representatives, or any other persons or organization acting within the scope of their employment or relation to RMIEA Inc. The pasenger agrees to hold harmless and to fully and completely indemnify RMIEA Inc., its officers, employees and representatives against any and all claims, suits and/ or judgments related to any of the matters as to which they are herein above released as well as against all claims, suits, damages, and / or judgments arising out of the acts or conduct of the passenger and/ or passenger's representatives, and against all loss, damage, liability, expense or cost by reason or on account of any such claim, suit or judgment. This release and indemnity agreement shall apply to all known, unknown and/or unanticipated injuries and damages resulting from or during the passenger's participation in the tour from any cause whatsoever, as aforesaid, and THE PASSENGER INDIVIDUALLY AND ON BEHALF OFALL OF HIS /OR HER AFORESAID REPRESENTATIVES, HEIRS, DEVISEES, LEGATEES, AND DEPENDENTS EXPRESSLY WAIVES THE PROVISIONS OF SECTION OF THE CIVIL CODE OF THE STATE OF MINNESOTA AND ANY SIMILAR PROVISIONS OF THE LAWS OF ANY OTHER JURISDITION, WHICH SAID SECTION READS AS FOLLOWS:
"A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of excuting the release, which if known by him must have materially affected his settlement with the debtor."
Terms and Conditions
Responsibility: Revival Ministries Intemational Evangelistic Association Inc.and their agents, officers and /or suppliers of services pursuant to or in conjuction with the itinerary in this brochure, shall act only as agents for the passenger in making arrangements for hotel, transportation, restaurants or any other service and do not assume any liability whatsoever for any injury, damage, death, loss, accident or delay to a person or property due to an act of negligence of or default of any hotel, carrier, restaurant, company rendering any of the services included in this brochure or by an act of God. Further, no responsibilities are accepted for any additional expense, omission, delays, rerouting or act of any government authority. The airlines concerned are not to be held responsible for any act, omission, or event during the time passengers are not on board their planes or conveyance. The passage contract in use by the airlines concerned when issued shall constitute the sole contract between the airlines and purchaser of this package and/ or passenger. The right is reserved to withdraw any portion of the package and /or make such changes in the program as may be found desirable for the convenience of the parties and the proper carrying out of the tour package. The price of this package is based on rates in effect (including foriegn currency exchange rates) at the time of printing and are subject to change at anytime with out notice. RMIEA Inc. does not assume responsibility for any errors or omissions in the content of this brochure.
